Terms of Service
- Be decent. No spam, bots, cheating the queue, or harassing anyone.
- Streamers run their own pages and decide what gets played. Sending a request doesn't guarantee it will be.
- Weight, Orbs, points and codes are just for fun. They have no cash value and can change or reset.
- You keep what you send us, and let us and the streamer show it on the page and on stream.
- The Service is provided as is. We can change it, or disable pages and accounts that break these terms.
1. Agreement to these terms
These Terms of Service ("Terms") are an agreement between you and tricipital ("we", "us", "our"), who runs levelrequest. By visiting or using the Service, logging in, sending a request, or creating a page, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.
If you use the Service for an organization, such as a team or a business, you agree to these Terms for it and confirm you have the authority to do so.
2. The Service
levelrequest lets streamers run a request queue for games such as Geometry Dash, Super Mario Maker 2, Beat Saber and osu!. The "Service" means levelrequest.com, every request page hosted on it or on a custom domain we connect, the stream overlays those pages provide, the levelrequest Twitch bot, Discord notifications, and anything else we offer under the levelrequest name.
Each request page is created and run by a streamer (a "streamer" or "page owner"). People who visit a page or send requests to it are "viewers". People a streamer lets help manage their page are "moderators".
3. Who can use it
You must be at least 13 years old to use the Service, and old enough to agree to these Terms where you live. If you're under 18, or under the age of majority where you live, you must have a parent or guardian's permission, and they agree to these Terms for you.
You may not use the Service if we've previously banned you, or if the law prohibits you from using it.
4. Accounts and logins
You log in to the Service with your Twitch account. You're responsible for what happens under your login, and for keeping your Twitch account secure. Tell us right away if you think someone else has used your login on the Service.
Your use of Twitch, and of Discord if you link it, is also governed by their own terms. If your Twitch account is suspended or deleted, you may lose access to parts of the Service.
5. Streamer pages
If you create a page, you are responsible for it. In particular:
- Your page, your rules. You choose your page's settings, rules, questions and links, which requests you play, and how. You must apply your own rules fairly, and anything you tell viewers about how levels are picked must be true.
- Your moderators. You're responsible for the people you make moderators, and for what they do on your page.
- Your viewers' information. You'll see what viewers send your page. Use it only to run your stream and your page, keep it private where the page doesn't make it public, and don't sell it or use it to contact viewers for unrelated purposes.
- Your channel. If you connect the levelrequest bot to your Twitch channel, you authorize it to act there with the permissions you approve, including running chat games, posting messages and announcements, and managing channel point rewards. You're responsible for complying with Twitch's terms and community guidelines in your channel, including for any giveaways you run.
- Your address. Your page's address is based on your Twitch name. We may change, reserve or reclaim an address, for example to resolve a dispute or prevent impersonation, and we may keep old addresses redirecting to new ones.
6. Acceptable use
You agree not to:
- break the law, or help anyone else break it;
- harass, threaten, bully or abuse anyone, or send hateful, sexually explicit, violent or otherwise objectionable content, including in level notes, names, links, questions, rules and chat;
- impersonate anyone, or misrepresent who you are or which account a request comes from;
- send spam, or use bots, scripts, multiple accounts, VPNs or other tricks to send extra requests, get around a queue limit, ban or cooldown, or gain weight, Orbs, points or prizes you wouldn't otherwise get;
- guess, share outside their intended use, sell or trade promo codes, weight codes or prizes, or exploit a bug to get them;
- scrape, copy or collect information from the Service in bulk, or use it to build another service;
- interfere with the Service, its security or its other users, including by probing for vulnerabilities, overloading it, or bypassing our bot checks and rate limits;
- reverse engineer the Service, except where the law allows it despite this restriction;
- post links to malware, phishing or anything designed to harm someone's device or account;
- use the Service in a way that infringes anyone's intellectual property, privacy or other rights.
If you find a security problem, please tell us privately using the details in section 19 rather than testing it on other people's pages.
7. Weight, Orbs, points and codes
The Service uses features such as weight, Queue Skips, Orbs, watch streaks, predictions, points, leaderboards, milestones, promo codes, weight codes and chat game prizes (together, "virtual items"). By using them you agree that:
- virtual items have no monetary value, are not property, and can't be sold, bought, exchanged for money, or transferred except through the features the Service provides;
- more weight raises your chances only where a streamer picks with weight. It never guarantees a level will be picked or played, and streamers may pick at random, in order, or by hand;
- predictions use Orbs only. They involve no real money, and you can't buy Orbs;
- streamers can reset, change, remove or turn off virtual items on their page, and we may do the same, for example to fix a bug or undo cheating;
- codes and prizes may expire, may be limited to one person, and may be cancelled if they were obtained in breach of these Terms.
8. Your content
"Your content" is anything you submit to the Service: requests, level codes, names, notes, video links, answers, rules, links, support messages and the like. You keep any rights you have in it.
You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, display, adapt for display, and share your content as needed to operate, secure and improve the Service. You also give the streamer whose page you send it to permission to view it and to show it on their page and on their stream, including in recordings, highlights and clips of that stream. This licence lasts while your content is on the Service, and afterwards for copies already in stream recordings or backups that we or the streamer can't reasonably remove.
You confirm you have the right to submit your content, and that it doesn't break these Terms or anyone's rights. We don't review content before it appears, but we may remove any content, or disable any page, that we believe breaks these Terms.
Feedback. If you send us suggestions or ideas, we may use them freely without owing you anything.
Reporting content. To report content that infringes your copyright or other rights, or that breaks these Terms, contact us with the page address, what the content is, and why it should be removed. If you're reporting copyright infringement, include your contact details, the work you believe is infringed, and a statement that you believe in good faith the use isn't authorised, and that your report is accurate.
9. Trademarks
levelrequest is not affiliated with, endorsed by or sponsored by Twitch, Discord, RobTop Games, Nintendo, Beat Games, ppy or any other game developer or platform the Service works with. Geometry Dash, Super Mario Maker 2, Beat Saber, osu!, Twitch, Discord and other names and logos belong to their respective owners and are used only to describe what the Service works with.
10. Third-party services
The Service relies on and links to services run by others, including Twitch, Discord, Cloudflare, GDBrowser, YouTube and the sites of the games it supports. We don't control them and aren't responsible for their content, availability or practices. Your use of them is governed by their own terms and policies. Level details such as names, ratings and comments come from those services as they are, and we don't guarantee they are accurate.
11. Payments
We don't take payments through the Service. If any feature depends on something you pay for elsewhere, such as a Twitch subscription, that payment is between you and the provider that takes it, under its terms and refund rules. We may change or stop any feature, including ones that depend on such a payment, as section 17 describes.
12. Suspension and termination
You can stop using the Service at any time. Streamers can ask us to delete their page, and anyone can ask us to delete their information, as our Privacy Policy explains.
We may suspend or end your access, disable or remove a page, or remove content, at any time and without notice, if we reasonably believe you've broken these Terms, if the law requires it, or if it's needed to protect the Service, its users or others. Streamers may also ban viewers from their own pages. Where it's reasonable and safe to do so, we'll tell you why.
Sections 7, 8, 9 and 13 to 18 continue to apply after your access ends.
13. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including any warranty of merchantability, fitness for a particular purpose, title or non-infringement. We don't warrant that the Service will be uninterrupted, secure, error-free or free of harmful components, that any request will be picked or played, or that any information on it is accurate.
Streamers, moderators and viewers act on their own behalf, not ours. We aren't responsible for what they say or do, on the Service or on stream.
Some places don't allow some of these disclaimers. Where that's the case, they apply only as far as the law allows.
14. Limitation of liability
To the fullest extent the law allows, tricipital will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill, audience or stream opportunities, arising from or relating to the Service or these Terms, even if we were told such damages were possible.
To the fullest extent the law allows, our total liability for all claims arising from or relating to the Service or these Terms is limited to the greater of the amount you paid us directly for the Service in the 12 months before the claim, or US $50.
Nothing in these Terms limits liability that the law doesn't allow to be limited, such as for fraud, or for death or personal injury caused by negligence.
15. Indemnity
To the extent the law allows, you agree to defend and compensate tricipital for any claims, losses, liabilities and costs, including reasonable legal fees, arising from your content, your use of the Service, your page and how you run it, or your breach of these Terms or of anyone's rights.
16. Disputes
If you have a problem with the Service, contact us first. Most things can be sorted out quickly, and we'll try in good faith to resolve any dispute informally within 30 days before either of us takes it further.
If you live in the European Union, the United Kingdom or another place whose consumer laws give you rights that these Terms can't remove, nothing here takes those rights away, including your right to bring a claim in the courts where you live.
17. Changes to the Service and these terms
We're always working on the Service, so features may be added, changed, limited to some pages, or removed at any time. We may also stop offering the Service. Where a change takes away something important, we'll try to give reasonable notice on levelrequest.com.
We may update these Terms. We'll change the date at the top, and for significant changes we'll give notice on levelrequest.com before they take effect. Continuing to use the Service after a change means you accept the updated Terms. If you don't, stop using the Service.
18. General
- Entire agreement. These Terms and the Privacy Policy are the whole agreement between you and us about the Service, and replace any earlier ones.
- Severability. If any part of these Terms can't be enforced, the rest still applies, and that part is applied as far as the law allows.
- No waiver. If we don't enforce a part of these Terms, we haven't given up the right to enforce it later.
- Assignment. You may not transfer your rights under these Terms. We may transfer ours, for example if the Service changes hands.
- No third-party rights. These Terms don't give rights to anyone except you and us.
- Events beyond our control. We aren't responsible for failures caused by things we can't reasonably control, such as outages at Twitch or our hosting providers.
- Language. These Terms are written in English. If they're translated, the English version applies.
